These Terms & Conditions apply between you, the user of this website, and We Sell Barrier, the owner and operator of this website.
By using this website and/or placing an order, you agree to be bound by these Terms. If you do not agree, you must stop using the website immediately.
Nothing in these Terms affects your statutory rights as a consumer.
1. Definitions
Contract: The agreement for the supply of goods between you and us.
Goods: Any products supplied by us.

Business Customer: A person or entity acting in the course of business.

2. The Contract
2.1 All orders are accepted subject to these Terms only. No variation shall apply unless agreed in writing by us.
2.2 Quotations are invitations to treat only and do not constitute a binding offer.
2.3 Orders may only be cancelled with our written agreement. We reserve the right to recover any costs or losses arising from cancellation.
2.4 You are responsible for ensuring the accuracy of all information provided with your order, including specifications and measurements.
3. Price & Payment
3.1 Prices are exclusive of VAT unless stated otherwise. VAT will be charged at the applicable rate.
3.2 We reserve the right to adjust prices prior to delivery to reflect increases in material, transport, or supplier costs.
3.3 Payment terms will be as stated at checkout or agreed in writing.
3.4 Late payments may incur interest at 8% above the Bank of England base rate.
3.5 We reserve the right to suspend or cancel orders where payment arrangements are not satisfactory.
4. Delivery
4.1 Delivery dates are estimates only and time shall not be of the essence.
4.2 Risk passes to you upon delivery.
4.3 You are responsible for providing suitable access and unloading facilities.
4.4 Additional delivery charges may apply where:
Access restrictions exist
Part loads are required
Special delivery requests are made
Orders are of small value
4.5 We may deliver in instalments and invoice separately.
4.6 If delivery cannot be completed due to your failure to provide access or accept delivery, we reserve the right to charge re-delivery or storage fees.
5. Inspection & Claims
5.1 You must inspect goods upon delivery.
5.2 Claims for short delivery must be reported:
By telephone immediately
In writing within 2 working days
5.3 Visible damage must be signed for as damaged upon delivery.
5.4 Failure to notify us within the stated timeframe will result in goods being deemed accepted.
5.5 Our liability for short delivery is limited to making good the shortage.
6. Returns
Returns are subject to our published Delivery & Returns Policy.
Goods must be unused, in original condition and packaging.
Restocking fees may apply to business orders.
Bespoke or modified goods are non-returnable.
7. Liability
7.1 Nothing in these Terms excludes liability for:
Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation
7.2 Our liability for any claim shall not exceed the purchase price of the goods concerned.
7.3 We shall not be liable for:
Indirect or consequential loss
Loss of profit
Business interruption
7.4 We shall not be liable for defects caused by:
Misuse
Incorrect installation
Wear and tear
Alteration or modification
8. Retention of Title
8.1 Risk passes on delivery.
8.2 Title remains with us until full payment has been received.
8.3 Until title passes, you must:
Store goods separately
Not alter or remove identifying marks
Keep goods insured
8.4 We reserve the right to recover goods where payment has not been made.
9. Insolvency
If you become insolvent or fail to meet payment obligations, we may:
Suspend deliveries
Cancel contracts
Require advance payment
Recover outstanding sums
10. Force Majeure
We shall not be liable for delay or failure to perform due to events beyond our reasonable control, including but not limited to:
Extreme weather
Transport disruption
Industrial disputes
Supply chain shortages
Acts of God
11. Intellectual Property
All website content, including text, images, and product descriptions, remains our property and may not be reproduced without permission.
12. Health & Safety
Certain goods may pose risks if improperly used. You are responsible for ensuring compliance with all health and safety regulations relating to storage, installation and use.
13. Waste & Disposal
You are responsible for disposal of goods in accordance with applicable waste and environmental regulations unless otherwise required by law.
14. General
14.1 These Terms are governed by the laws of England and Wales.
14.2 We may amend these Terms at any time by updating the website.
14.3 If any provision is found invalid, the remaining provisions remain in effect.
14.4 We may assign or subcontract any part of the Contract.
14.5 Nothing in these Terms grants rights to third parties.
